IM man pleads no contest to attempted sexual assault
IRON MOUNTAIN — An Iron Mountain man accepted a plea deal Monday on a criminal sexual conduct charge after a judge indicated she likely would grant a delayed sentence in the case.
Jarmmy-Josue Mebius Flores, 27, pleaded no contest to attempted criminal sexual conduct-third degree-incapacitated victim, a five-year felony.
Flores reportedly had sexual contact with a female who was asleep at the time of the incident Aug. 21, 2016, in Iron Mountain, according to the criminal complaint.
In exchange for the plea, the Dickinson County Prosecutor’s Office dismissed the initial, more serious charge of criminal sexual conduct-third degree, a 15-year felony.
During an earlier court hearing, Judge Mary Barglind said she intended to order a delayed sentence, which would allow Flores the opportunity to avoid a felony conviction and lifetime registration as a sex offender if he successfully completes probation.
However, the judge noted she has yet to see the pre-sentence investigation report that could change her mind.
Barglind will make a final decision at sentencing Dec. 5.
