Kingsford man awaits sentencing in domestic violence case
IRON MOUNTAIN – A Kingsford man will be sentenced Dec. 5 for a 2016 domestic violence incident in Iron Mountain that left a woman with a bruised neck and broken nose.
Benjamin Macario Martinez, 35, pleaded no contest Monday in Dickinson County Circuit Court to aggravated domestic violence-second offense, a five-year felony, and a habitual offender-third status, which increases the maximum penalty to 10 years.
The Dickinson County Prosecutor’s Office agreed to dismiss a misdemeanor domestic violence charge and Martinez’s initial habitual offender-fourth status, as well as recommend an 18-month prison sentence.
Martinez and the woman were arguing Sept. 18, 2016, when he reportedly choked her, causing significant bruising on her neck, according to the criminal complaint.
A witness then saw Martinez “head-butt” the woman in the face so hard it knocked her to the ground and broke her nose, the complaint states.
