Probation for assault suspect

FLORENCE, Wis. - An Iron Mountain man was sentenced on Tuesday to two years of probation after he pleaded no contest to charges stemming from an altercation at the C & R Bar in Aurora, Wis. on March 8.

Justin James Murphy, 26, had been charged with one felony count of substantial battery-intend bodily harm and one misdemeanor charge of disorderly conduct. As part of a plea agreement, the charges were reduced to misdemeanor battery and disorderly conduct.

According to Florence County District Attorney Doug Drexler, Judge Leon D. Stenz gave Murphy a stayed sentence of ten months incarceration. Murphy will not have to serve jail time as long as he follows the terms of his two-year probation, which includes 250 hours of community service, no consuming alcohol, and possible additional restitution.

Deputies from the Florence County Sheriff's Department arrested Murphy on March 8 after he assaulted 50-year-old Greg Krans of Aurora, Wis., a C & R Bar employee who was trying to escort him off the premises.

Police reports at the time of the incident indicated that Krans suffered a head injury during the fight.

Drexler said that Krans' statement in court likely influenced Judge Stenz's sentencing.

Krans told Judge Stenz that the altercation occurred during Murphy's bachelor party, and that Murphy typically doesn't drink, said Drexler.

"Krans said it was out of character for Murphy to be violent, and he didn't think that jail time would be appropriate," Drexler added. "He (Krans) recommended that Murphy get community service and compensate him for lost wages."

Maybe the "guy that got 18 months" had a worse criminal record than this guy. That's taken into account at sentencing. Besides this is what the victim wanted. That hold a lot of weight too.

Ladyred, it sounds to me like the only mistake your friend made that Justin did not was getting into it with the wrogn people. Justin can thank his lucky stars that Greg Krans was willing to stand up for him and ask for no jail time. I am very impressed by his (Krans) actions. I know Justin, although not too well, and have never known him to be like that. For everything Krans has been through with this and then stand up basically as a character witness and ask the court that Justin only receive probation is pretty big of him.

It depends who you are as I agree with a previous post that some have gotten much tougher punishment for much less. But again we have a "plea" agreement that is off the wall.

Wow, I thought he would get more. I guess Greg's comments helped this guy out. I dont know either of these people personally, but it doesnt seem like this Justin kid should have his whole life ruined for a mistake.

What's good for the goose should be good for the gander, but not up here. The system wastes more time and money on this crap than they should. Boys will be boys, good, bad or indifferent. The guy that got 18 months is a good guy too, but did that make any difference, he jumped in to save a wiesel from being hurt by a group of town favorites, so he should pay 18 months of his life for being there and all the other idiots go on with life. Drexler and most of the ones in the system should sit in prison for a while maybe they would adjust their superior attitude.

i seen it happen n it seemed like justin was going out of the bar n greg got in his way.im glad he got no jail time.

Thank God.. Justin does not deserve jail time. Obviously none of you know Justin, he's a great guy who just made a mistake...he's human.

I dont see anything wrong with this.If Greg said this is must be true.Greg has been at the C and R for years and ALWAYS has been a great guy .Greg would NOT of wanted this guy off scott free if he was a D*** like most BOYS who go there looking for trouble

Well isn't that nice, must be a friend of Drexler, I know someone who got 18 months in prison for a C&R fight, and the persons who started it got off!!! I am happy for this guy, but where does the law draw the line?
