CRYSTAL FALLS - David Anthony Levack was found guilty today of felony counts of open murder, felony murder, home invasion, and witness intimidation in the death of 81-year-old Joyce Johnson of Stambaugh Township.
Levack, 45, was accused of killing Johnson before she could testify against him in a stolen property trial on Sept. 27, 2011.
The jury was asked to render a guilty or not guilty verdict on four separate charges:
- Open murder, which can either be first degree premeditated murder or second degree murder. Jurors found Levack guilty of first degree premeditated murder.
- Felony murder, which is murder committed while another felony crime is being or has been committed.
- Home invasion, which is breaking into a dwelling either with a dangerous weapon or while another person is lawfully in the dwelling.
- Witness intimidation, which is discouraging someone from attending, giving information, or testifying at a court proceeding.
