Niagara shooting suspect in court

MARINETTE, Wis. - A Niagara, Wis. man accused of shooting vehicles and threatening a female victim with a rifle made his first appearance in Marinette County Court on Thursday.

Cody J. Rose, 23, had originally been scheduled for an initial appearance on Feb. 4.

Officials from the Marinette County Clerk of Courts office said that Rose's initial appearance was postponed because he had requested a change of judge.

Judge David G. Miron had been assigned to the case. Now, Judge James A. Morrison is presiding over the case.

Judge Morrison scheduled Rose for a preliminary examination on March 11.

Rose remains incarcerated in the Marinette County Jail.

He faces one felony count of discharge a firearm at a vehicle, one felony count of burglary to a building or dwelling, one felony count of recklessly endangering safety-second degree, two misdemeanor counts of criminal damage to property, and one misdemeanor count of disorderly conduct.

If convicted on all counts, Rose could spend up to 35 years in prison.

The charges against Rose stem from a Jan. 18 incident in Niagara.

According to the criminal complaint in the case, witnesses said that Rose was angry at another man for stealing from him.

Rose allegedly drove to the 700 block of Vine Street in Niagara, where the man's vehicle was parked, and used a rifle to shoot the windows and the passenger side of the vehicle.

Another vehicle that was parked next to the man's vehicle sustained gunshot damage to its front passenger side window.

The vehicle owners were not present when the shooting occurred.

The complaint also alleges that around the same time, Rose entered the man's residence in the town of Niagara and threatened the man's girlfriend with the rifle.
