Houghton murder suspect incompetent to stand trial

HOUGHTON - The Houghton man accused of killing an elderly woman at the Douglass House Apartments in Houghton in September was found incompetent to stand trial in Houghton County District Court Thursday.

Timothy Cadeau, 29, was ordered to undergo up to 15 months of treatment in order to become competent to stand trial.

If he is not judged to have improved enough by the 15-month mark, he will be put directly into the state mental health system for long-term hospitalization, said Prosecutor Michael Makinen.

The case is being held in abeyance during Cadeau's treatment.

Cadeau appeared via videoconference from Ypsilanti, Mich. He was taken to the state Center for Forensic Psychiatry there after his arraignment in 97th District Court on Oct. 1.

Prosecutor Michael Makinen read from a report filed Thursday after a forensic examination in Ypsilanti. The doctor stated Cadeau "is incompetent to stand trial, but if provided a course of treatment, will attain competence to stand trial within the time limit established by law."

During that time, Cadeau will remain under the custody of the Michigan Department of Mental Health. Cadeau will be will be restricted to the building and grounds of the recommended facility. If he needs to be taken to detention, sheriff's department personnel will transport him.

Before the hearing, Cadeau's attorney, David Gemignani, requested to speak privately with his client. Cadeau did not respond verbally, but denied the request by shaking his head after the second time being asked.

Cadeau is accused of killing Geraldine Fouts, 84, a fellow resident of the apartments, on the morning of Sept. 28. Police found Fouts' body at her residence after responding to a report of a breaking and entering. Police took Cadeau into custody at the apartments that afternoon.

Cadeau is charged with homicide - open murder, a felony punishable by life in prison, and first-degree home invasion, a 20-year felony.
