Jail sentence in IM meth case

IRON MOUNTAIN — An Iron Mountain man who had methamphetamine when arrested on a probation violation was sentenced Tuesday to a year in jail and two years of probation.

Joshua Edward Faccio, 26, had pleaded guilty to felony possession of methamphetamine in Dickinson County Circuit Court.

Faccio was sentenced earlier this year to 93 days in jail and two years of probation for misdemeanor domestic violence.

Officers arrested him Aug. 29 on a suspected probation violation and found suspected marijuana, an unknown pill and a white substance Faccio identified as methamphetamine, according to the criminal complaint.

Defense attorney Daniel Jaspen urged Judge Mary Barglind to take into account Faccio’s charge was for simple possession, not delivery. Dickinson County judges have a history of being tough on methamphetamine cases, he noted.

Faccio told the court he wanted to go to a rehabilitation program and was eager to prove he can change.

Dickinson County Prosecutor Lisa Richards argued harsh sentences send the message methamphetamine will not be tolerated in this community. However, she cited Faccio’s work history, age and Michigan sentencing guidelines as reasons she agreed with a jail sentence instead of prison.

Barglind ordered the jail term but warned Faccio he likely would go to prison if he again violates probation.
