Town doesn’t have to take care of possible cemetery

MADISON, Wis. (AP) — The state Supreme Court says a southwestern Wisconsin town doesn’t have to take care of land a group contends is a cemetery.

At issue is a one-acre parcel that abuts Wildcat Mountain State Park. A group of people believe their relatives are buried there, although no headstones stand on the land. The group has asked the Town of Forest to assume ownership of the land and maintain it, invoking a state statute that towns shall take charge of cemeteries that are abandoned or falling into disuse if no authority exists to transfer ownership.

The Supreme Court ruled 7-0 on Thursday that the group failed to prove the parcel is a cemetery and therefore isn’t subject to the statute.
