Iron Mountain man pleads not guilty to OWI charge

IRON MOUNTAIN — An Iron Mountain man accused of operating while intoxicated in November pleaded not guilty Tuesday in Dickinson County Circuit Court.

Isaac Callaway, 43, is charged with operating while intoxicated, third offense, a felony punishable by up to five years in prison; operating while license suspended, revoked or denied, second offense, a one-year misdemeanor; operating an unregistered vehicle, a 90-day misdemeanor; and operating a motor vehicle without security, punishable by up to one year in jail.

Callaway also is classified as a four-time habitual offender, which means he could serve up to life in prison if convicted.

Callaway waived arraignment and was not required to appear in court in person. The not guilty pleas were entered on his behalf by Dickinson County Circuit Judge Mary Barglind.

According to the criminal complaint, officers with the Iron Mountain Police Department found Callaway unconscious in the driver’s seat of a running motor vehicle on West Brown Street in Iron Mountain on Nov. 3.

The driver’s side window and door were covered in vomit that smelled strongly of intoxicants, the complaint stated.

Officers woke Callaway, who reportedly was confused, had slurred speech and was unable to stand on his own, the complaint stated. He admitted consuming alcohol and kratom, an extract from a South Asian plant, before driving.

Callaway registered a .135 percent blood-alcohol content on a preliminary breath test, the complaint stated.

A pre-trial conference is set for Jan. 20.
