IM man imprisoned for firing gun in bar

IRON MOUNTAIN — An Iron Mountain man has been ordered to serve 30 months to 10 years in prison after firing a revolver in a Norway tavern last fall.

According to the complaint, John Aversano Jr., 36, entered Mister Mom’s in Norway on Nov. 19 in possession of a concealed revolver. Aversano became intoxicated and when the bartender asked him to leave he pulled out the gun and fired a round toward the bartender, but it struck the floor. No injuries were reported.

Aversano fired one more round outside of the bar and then fled, discarding the revolver on the side of the road. When he was located by law enforcement, he was still in possession of an empty holster and several rounds for the revolver.

Aversano pleaded guilty in Dickinson County Circuit Court to single counts of felony firearms — discharging in or at a building; assault with a dangerous weapon (felonious assault); and misdemeanor firearms — possession on restricted premises.

Aversano was sentenced Monday by Judge Christopher Ninomiya to serve 30 months to 10 years on the discharging a weapon charge, one year on the assault charge and 90 days for the possession on a restricted premises charge. All sentences may run concurrently.

Aversano’s attorney, Daniel Jaspen, asked the court for leniency in handing down a sentence, noting that the pre-sentencing report had found him eligible to serve his time in bootcamp.

District Attorney Lisa Richards argued to the contrary, citing the impact on the victim and the fact that Aversano had lied about his address, further traumatizing the victim.

Richards asked that, based on the serious emotional distress suffered by the victim and Aversano’s prior criminal record, the sentence should be no lower than the mid range.

Ninomiya, in his remarks, tended to agree with the prosecution.

“The court is required to consider four primary objectives of punishment, rehabilitation, deterrence and protection of society,” Ninomiya said. “All four of those are relevant. Mr Aversano comes before this court having committed an extremely serious offense that resulted in the discharge of a firearm,” he said.
