Four factors for assessing a judge
Can a judge be assessed using a negative stereotype seen in political ads?
My belief in assessing this is that judging the performance of a judge means looking at four factors.
The first is whether the decision is within the sentencing guidelines and a violation of established law. The sentencing, I believe, should be within prior precedent. Stereotypes do not tell you that.
Secondly, judges need to see that the law is applied without consideration for gender, race, religion, sexual preference or economic means and status. These things seem to me to be ignored in the stereotypic political ads.
The third factor is accountability. The question here asks if the sentence creates. sufficient accountability to deter future violations. This is clearly a judgment call that will likely vary from person to person based on a number of psychological factors and social support systems he has.
The fourth factor is decreasing the chances of recidivism. Does the time offer opportunities to acquire skills and insights that help the person choose positive interactions, and develop positive goals for work and personal relationships?
The determination of guilt is only fair and valid if judgment fulfills the above considerations and a competent legal defense is given. The danger of not doing these things increases the chances seen in the New York Central Park rape case that sent five young black men to jail for about 20 years for a crime later shown they did not commit.
