Niagara man sentenced to prison for sexual assault
A Niagara, Wis., man who was an associate pastor has been sentenced to 20 years in prison for sexually assaulting a child.
Marinette County Circuit Judge James Morrison also gave 56-year-old David Lyman another 20 years on extended supervision for the offense, a Class B felony that according to the criminal complaint occurred from January 2017 and June 2019 in Lyman’s home, when the child was age 7 or 8.
Lyman was sentenced Aug. 31 in Marinette County Circuit Court after pleading no contest June 11 to repeated first-degree sexual assault of a child. A Class C felony charge of incest with a child — Lyman is related to the victim — was dismissed, as were five counts of possession of child pornography that had been filed in January.
The prosecutor had agreed to recommend a 10-year prison term and 15 years of extended supervision in exchange for the no-contest plea, which was aimed at avoiding having the child testify.
But Morrison said in court the crime deserves a more severe term given some of the other accusations also made against Lyman, noting he could have gone up to 40 years in prison. He also considered the child pornography charges that were read in at sentencing.
Lyman also will be required to remain on the state’s sex offender registry for life.
