Officers cleared in fatal Goodman shooting

MARINETTE, Wis. — The Marinette County District Attorney’s Office says five police officers have been cleared in a fatal officer-involved shooting that occurred in Goodman late last month.

The Wisconsin Department of Justice Division of Criminal Investigation determined the officers acted appropriately in response to a threat of deadly force, said District Attorney DeShea Morrow. No charges will be brought against the officers.

The evidence included witness statements, squad vehicle camera footage, calls made by the deceased to dispatch, and physical evidence from the scene.

John Lipski, 62, of Milwaukee, was shot and killed by law enforcement following the murder of Richard Gibbs, 62, also of Milwaukee.

According to the DCI report:

— At about 5 p.m. on Oct. 23, a man called Marinette County Dispatch Center and said he had just killed his best friend and wanted to die. He said that if police came, he would shoot them.

— Marinette County Sheriff’s Office deputies responded to the address in Goodman, along with the county’s special response team and members of the Florence County Sheriff’s Office. Deputies observed that the suspect had a gun in his hand when he came out of the house.

— The suspect left the house in his SUV, driving out of town and onto a recreational trail. The lead sheriff’s vehicle in pursuit waited for other squads to arrive before turning on its emergency lights.

— After exiting the vehicle, the suspect walked on the road with a handgun in his right hand. Deputies yelled multiple times for him to drop the weapon. He refused and walked towards a piece of heavy machinery parked on the side of the road. He again refused commands to drop the weapon.

— The suspect walked back towards the road, raised his right arm and pointed the gun at deputies. They fired at the suspect, striking him and killing him.

— Deputies went to the house where the suspect had been and found Gibbs dead from an apparent gunshot wound.

No officers were injured. The involved officers, all from the Marinette County Sheriff’s Office, had been placed on administrative assignment, per department policy.

They are: Lt. Barry Degnitz, 27 years in law enforcement; and deputies Jesse Parker, 19 years in law enforcement; Patrick Callahan, four years; Dave Oginski, 15 years; and Steve Schmidt, 12 years.

Although a resident of the greater Milwaukee area, Lipski co-owned a house in Goodman.

The Department of Justice had previously determined that Gibbs died of a gunshot wound and that Lipski committed the murder. The DOJ will make its full report available to the public at a later date, Morrow said.

“The Marinette County District Attorney’s Office also wishes to offer condolences to the family and friends of both John Lipski and Richard Gibbs,” Morrow said.
