Iron Mountain man receives one-year jail sentence for aggravated indecent exposure

IRON MOUNTAIN — An Iron Mountain man was sentenced Tuesday in Dickinson County Circuit Court to one year in jail for masturbating in the window of his home.
Brian Legault, 54, will also spend two years on probation for aggravated indecent exposure, a high court misdemeanor punishable by up to two years in prison.
As a three-time habitual offender, Legault could have served as many as four years in prison.
Defense attorney Greg Seibold said Legault knew the wrongfulness of his “inexplicable” conduct, acknowledging his client had a lengthy criminal record while noting Legault’s last conviction occurred about 10 years before his most recent offense.
“He desires to refrain from similar conduct in the future,” Seibold said.
Chief Assistant Prosecuting Attorney Kristin Kass said she still had many questions about the incident and asked what steps Legault would take to change. “Until he does something in that direction, I fear this behavior will not be under control,” Kass said.
Legault apologized for his actions.
Dickinson County Circuit Judge Mary Barglind said the pre-sentence investigation report’s recommendation for one year in jail was appropriate but increased probation from 18 months to two years.
According to the criminal complaint, the Iron Mountain Police Department received two phone calls about 3 1/2 hours apart reporting Legault was masturbating in the window of his home Sept. 16. When officers reached the residence, they reportedly saw Legault committing the act.
Legault initially had been charged with two counts of aggravated indecent exposure as a four-time habitual offender, but Kass agreed to dismiss one count and reduce the habitual offender notice in exchange for Legault’s guilty plea.
Additionally, Kass dismissed a sexually delinquent notice, a violation punishable by imprisonment for an indeterminate term between one day and life.
